IN THE MAGISTRATE COURT OF ATHENS-CLARKE COUNTY
STATE OF GEORGIA

WARRANT APPLICATION NUMBER: MC-01-CR-MS-03-0616 (Theft by Retaining)

STATE OF GEORGIA,

VS.

WILLARD DALE GRIEVER and
NORMA LYNNE GRIEVER,

Defendants.

Order

This Warrant Application was scheduled for a hearing on January 8, 2004. Mr. Staddon appeared and the Defendants failed to appear after notice was sent to their residence. The Clerk also attempted to contact the Defendants by phone prior to the hearing.

After hearing the evidence, the Court finds that probable cause exists to issue two felony warrants for theft by retaining against Mr. Griever for unlawfully retaining a 1982 Mercedes Benz and a Baby Grand Piano property of Mr. Staddon. The Court also finds that probable cause exists to issue two felony warrants for theft by taking against Ms. Griever for unlawfully retaining a 1982 Mercedes Benz and a Baby Grand Piano.

At this time the Court will hold these warrants in abeyance for a period of 30 days. If during that time, the Defendants allow Mr. Staddon to retrieve the above-listed items along with a Pentium 133 computer, an AMD Athlon 400 computer and companion monitor then this application will be dismissed.

If the Defendants fail to allow Mr. Staddon to retrieve these items, then a show cause hearing will be held on February 9, 2004 at 9:30 a.m., at which time the Court will issue the aforementioned arrest warrants unless good cause is shown.
