Dear Ed,

I received your letter concerning mediation and discovery. On June 9, 2005, I notified you that a volume of documents were available for your client's inspection and copying, and suggested that inspection take place during the week of June 27. I received no response to that communication, but the documents are still available for your client's inspection.

I have not received a response from you regarding your client's position on binding arbitration, which will be a less costly alternative to mediation and trial. I suggest that we use Denny Galis as an arbitrator if your client is in agreement. If I do not hear from you by the end of the month regarding this matter, I will request a mediation date. Please call me if you would like to discuss this further.

Plaintiff's written responses to interrogatories and document production requests are being prepared and will be delivered no later than next week.
